Terms of Service

1. Eligibility

You must be at least 18 years old to use kyndl. By opting in or using the service, you confirm that you meet this age requirement and that any phone number you provide belongs to you.

2. Description of Service

kyndl is an automated coaching service designed to support people who are quitting or cutting back on tobacco and nicotine. It is offered two ways:

• SMS coaching — a pre-written message sequence (up to 6 months) with motivational support, behavioral guidance, milestone recognition, and keyword-based responses to common needs (e.g., URGE, SLIP, HELP).
• Web AI coaching — a chat with an AI coach (Sol, Sarge, or Sage) that generates responses to your messages in real time.

kyndl is not a medical service. The content provided — whether by SMS or by a web coach — is for informational and motivational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical guidance related to quitting tobacco or nicotine dependence.

The web coaches are powered by AI. Their responses are generated automatically and may be inaccurate, incomplete, or not appropriate for your situation. They are not a substitute for professional medical, clinical, mental-health, or crisis care, and they are not delivered or reviewed by a licensed professional. Use your own judgment, and do not rely on a coach's response for any decision that warrants professional advice.

3. SMS Messaging & Consent

By submitting your phone number, you expressly consent to receive recurring automated SMS messages from kyndl at the number provided. Message frequency varies by phase (up to 3 messages/day during the first three days, tapering over 6 months). Message and data rates may apply.

You can opt out of SMS at any time by replying STOP to any message; you will receive a confirmation and no further messages. Reply HELP at any time for support resources and opt-out instructions. (Opting out of SMS does not delete data you have already provided — see our Privacy Policy.)

4. Not an Emergency Service

kyndl provides support and motivation, but it is not an emergency or crisis service and is not monitored in real time by a person. If you are in crisis or thinking about harming yourself, call or text 988 (the Suicide & Crisis Lifeline) or your local emergency number. For free quit-support, you can also call 1-800-QUIT-NOW. We make no guarantees about cessation outcomes; success depends on many individual factors outside our control.

5. Acceptable Use

You agree not to:

• Provide false information during enrollment
• Use kyndl for any unlawful purpose
• Attempt to disrupt, reverse engineer, or interfere with the service
• Attempt to manipulate the AI coaches into producing harmful, unsafe, or off-purpose content, or use the service to generate content unrelated to nicotine cessation support
• Share your enrollment in a way intended to circumvent opt-in requirements

6. Intellectual Property

All message content, branding, and design associated with kyndl are owned by or licensed to Michael Semensi. You may not reproduce or distribute kyndl content without written permission.

7. Limitation of Liability

kyndl is provided "as is" without warranties of any kind, express or implied, including with respect to the accuracy or reliability of AI-generated responses. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the service.

8. Termination

We may suspend or discontinue the service, in whole or in part, at any time. You may opt out of SMS at any time by replying STOP, and you may stop using the web chat at any time.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of kyndl after changes constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
